Who is responsible for medical payments when a bicycler is hit by a car, auto insurance or health?

My wife was hit by a car while riding her bicycle on the sidewalk. She needed surgery and now bills are really adding up. Our health insurance says the auto insurance is responsible and the auto insurance says our health insurance is responsible. We are constantly being handed back and forth should we seek out a lawyer and risk owing more money to more people? What steps should we take? Are we out of luck? We live in the state of Michigan.

Michigan is a no fault state, so if you have your own auto insurance, you should be seeking medical coverage from them, even if your wife was on her bike.Contact your auto insurance company and make a PIP claim. If you dont have auto insurance, then your health insurance should be paying, and then seeking reimbursement from the driver's auto insurance company.Hope your wife heals quickly.

What was she doing cycling on the sidewalk? Sidewalk cycling is very dangerous - it leads to a lack of visibility that can result in intersection or driveway crashes. She should have been cycling in the road, where she would have been much more visible and therefore safer. If the insurance people are handing you back and forth, you have little recourse but to the law.

No. The insurance company cannot remove a lapse in coverage. They will not backdate a policy. It's simple-you let your policy lapse by two days for failing to make the payment on time.
